Article 1 - Definitions
In these terms and conditions: • Echonovo: Echonovo is a project of MD Medic BV, located in Ghent, Belgium. VAT BE 0674 465546. • Customer: the natural or legal person who enters into an agreement with Echonovo. • Product: ultrasound equipment, accessories and related services. • Agreement: any arrangement between Echonovo and the customer.
Article 2 - Applicability
These terms and conditions apply to all offers, quotations and agreements between Echonovo and the customer. Deviations from these conditions are only valid if agreed in writing.
Article 3 - Quotations and Prices
All quotations are non-binding and valid for 30 days unless otherwise stated. Prices are exclusive of VAT and any installation costs unless expressly stated otherwise. Echonovo reserves the right to change prices.
Article 4 - Delivery
Delivery times are indicative and not binding. Echonovo is not liable for damages resulting from exceeding the delivery time. The risk of the products transfers to the customer upon delivery.
Article 5 - Warranty
Echonovo offers warranty on new products in accordance with the manufacturer's warranty. For Pre-Loved products, a warranty of at least 6 months applies unless otherwise agreed. The warranty expires in case of incorrect use, external damage or repairs by third parties.
Article 6 - Payment
Payment must be made within 30 days of the invoice date unless otherwise agreed. In case of late payment, the customer is automatically in default and Echonovo is entitled to charge statutory interest.
Article 7 - Liability
Echonovo's liability is limited to the invoice amount of the relevant delivery. Echonovo is not liable for indirect damage, consequential damage or loss of profit.
Article 8 - Intellectual Property
All intellectual property rights to documentation, software and training materials provided by Echonovo remain the property of Echonovo or its licensors.
Article 9 - Disputes
Belgian law applies to all agreements. Disputes are submitted to the competent court in Ghent.
